A Commissioner for Oaths is a person appointed by the Chief Justice of the Federal Court under Section 11(1) of the Courts of Judicature Act 1964 and the Commissioner for Oaths Rules 2018, and is empowered amongst others to administer oaths for the taking of any affidavit or affirmation and taking and receiving statutory declarations. See Rule 9 and/or Rule 10 of the Commissioner for Oaths Rules 2018.
Our Commissioner for Oaths operating hours are as follows:-
Monday – Friday
8:30am – 5:00pm.
(Lunch 1:00pm – 2:00pm)
Saturday, Sunday and Public Holidays
Closed.
It is preferable that you make a prior appointment as our Commissioner for Oaths is also a practicing advocate and solicitor of the High Court of Malaya who may have to attend court hearings / meetings with client etc on certain days. For Malaysian citizens, your original identity card / driving license.
For Foreigners, your passport / UNHCR card or any other document to verify your identity and nationality.
It will vary from 5 minutes to 15 minutes or more, depending on the type and quantity of documents to be affirmed as well as the queue. Also, for deponents who are blind, illiterate, or who require an interpreter, the process is expected to be longer.
No. Pursuant to the Federal Court’s Practice Direction dated 13th June 2005, a Commissioner for Oaths is not allowed to certify true copy any document.
No. The deponent has to be physically present before the Commissioner for Oaths when affirming his / her affidavit / statutory declaration etc.
